Ray Epps, a 62-year-old former Marine and Arizona resident, has been at the center of controversy following the January 6, 2021, U.S. Capitol riot. On Tuesday, federal prosecutors recommended a six-month prison sentence for Epps, who pleaded guilty to a misdemeanor charge of disorderly conduct on restricted grounds. His sentencing is scheduled for next Tuesday.
Epps’ involvement in the riot included participation in a group effort to push past police lines, as captured in videos. Despite not entering the Capitol building or physically engaging with law enforcement officers, his actions were deemed aggressive and contributory to the riot. Epps surrendered to the FBI two days after the incident, upon learning he was being sought for identification.
The Conspiracy Theory:
Epps became a focal point of a right-wing conspiracy theory after the riot. This theory falsely alleged that he was an undercover government agent, specifically an FBI operative, who incited the Capitol attack. The theory gained traction on right-wing news platforms, leading to significant personal repercussions for Epps, including death threats and relocation. The media attention has caused Epps to sell his business and live in seclusion, fearing backlash.
Assistant U.S. Attorney Michael Gordon, during Epps’ plea hearing in September, clarified that Epps was not a confidential source for the FBI or any other law enforcement agency. Despite this, the conspiracy theory persisted, amplified by media outlets.
Epps responded to these allegations by filing a defamation lawsuit against Fox News Channel, accusing them of propagating the claims.
